Sessional Paper No. 02 of 2018 on National Ethics and Anti-Corruption Policy

Abstract

The National Ethics and Anti-Corruption Policy is anchored on the Political Pillar of Kenya Vision 2030. The MTP II identifies National Values and Ethics as one of the cornerstones of the Country's overall development through a value-based system. The elements identified in the Kenya Vision 2030 strategy adhere to our national values and ethics and the same are re-emphasized under Article 10 (National Values and Principles of Governance), Article 232 (Values and Principles of Public Service) and Chapter 6 (Leadership and Integrity) of the Constitution of Kenya, 2010. The development of this Policy is also informed by the historical developments in the fight against corruption. In 1997, Kenya made considerable strides in the fight against corruption with the amendment of the Prevention of Corruption Act (Cap. 65) which paved way for the establishment of the Kenya Anti-Corruption Authority (KACA). However, the war on corruption has not been smooth and has endured numerous legal and administrative challenges. The lack of a coherent strategy has been cited as one of the biggest setbacks to the effectiveness of the fight against corruption.

This Policy will provide a comprehensive framework for the design and development of an effective legal and institutional framework for fighting corruption and promoting ethics and integrity in Kenya and also ensure effective monitoring and evaluation of the efficacy of anti-corruption measures. The policy is a product of a collaborative and participatory process and reflections on how to strengthen the legal and institutional framework for the fight against graft particularly with a view to building synergies among institutions, harnessing the collective goodwill of the people of Kenya and stakeholders and re-assigning roles and resources that are available to ensure that we win the war against corruption and not just the battles.
